Motorola-Apple judge decries US patent system - v3.co.uk

The judge who dismissed Apple's attempts to ban Motorola Mobility products in the US has called out the current patent system as "out of sync."

Illinois state judge Richard Posner openly stated his weariness of the software industries use of patents. In an interview with Reuters the judge compared software litigates to animals struggling for survival and calls the patent system a jungle with far out reaching rules.

Posner's recent calls for changes in the patent system add to the growing cries to see changes in the way patents are handled in the US.

"It's a constant struggle for survival," Posner said.

"As in any jungle, the animals will use all the means at their disposal, all their teeth and claws that are permitted by the ecosystem."

Speaking at the US Court of Appeals in Chicago, judge Posner candidly questioned the need for patents in many industries. The outspoken judge stated that software firm's expansive financials unfortunately make patent litigation an appealing avenue for hampering competition.

"It's not clear that we really need patents in most industries," he added. "You just have this proliferation of patents. It's a problem."

Posner presided over the recent Apple patent case against Motorola Mobility. Both companies were seeking sales injunctions against each other. Judge Posner shot down the two competitors cases on the grounds that the firms could not establish reasonable cause for an injunction.

The judge's recent comments go in line with what others are saying about the current US patent system. In 2007 the Electronic Frontier Foundation called for global patent system reform, while billionaire Mark Cuban recently suggested that major firms could suffer critical financial damage unless the system is reformed.

Tech firms have recently come out in favour of reform as well. Twitter promised to change the way it handled patents earlier this year, and Apple chief executive Tim Cook noted his for reticence towards patent litigation late last year.

Motorola DEFY PRO comes with a 2GB microSD memory card in the sales package, but users can further expand storage up to 32GB.

As part of the alliance, the company has launched the limited edition TDKR Lumia 800, priced at Rs 24,999.

"Starting mid-July, 200 units of a special edition of Lumia 800 with smartphones with laser etched Batman logo and an exclusive for Lumia DKR App will be available exclusively for consumers in India," Mehrotra said.

Also, Nokia Lumia users will get access to exclusive content from the movie, including exclusive trailers, movie information, ringtones and games.

"A global initiative, the Nokia Lumia Dark Knight Rises campaign is an exciting initiative for Lumia consumers, that will recreate the movie's experience, right on the consumer's devices. The initiative will be supported by a full 360 degree marketing campaign," Mehrotra said.

New Delhi, July 6 — Finnish handsets manufacturer Nokia Friday launched Lumia 610 priced at Rs.12,999 in the Indian market.

The company has already launched Lumia 800 and Lumia 710 priced at Rs.24,999 and Rs.15,999 respectively.

"The smartphone will introduce Windows Phone to a new generation of smartphone users," Vipul Mehrotra, director-smart devices, Nokia India, told reporters here.

"It is designed to appeal to a more youthful audience purchasing their first smartphone and motivated by the opportunity to keep in touch with friends, family and all the latest information," he added.

Running on the latest version of Windows Phone 7.5, Lumia 610 comes preloaded with Nokia's suite of experiences including Nokia Maps, Nokia Drive and Nokia Transport in addition to over 1,00,000 apps to choose from on the Windows marketplace, the built-in Microsoft Office app and Xbox Live.

The smartphone comes equipped with 800 MHz processor and 8 GB of internal storage and features 3.7-inch display and a 5MP camera.

Nokia also said that it has partnered with Warner Brothers for providing exclusive content of its upcoming movie -- The Dark Knight Rises -- including its trailors, ringtones, wallpapers etc.

Apart from the content, the company also plans to release 200 units of the Dark Knight Rises version of Nokia 800 under a limited edition priced at Rs.25,999 starting mid-July.

According to a study conducted by CyberMedia Research, though Nokia continues to be the market leader with 23 percent market share in the overall category, it has lost grounds to Samsung in the smartphone category.

Samsung holds 40.4 percent market share in the smartphone category followed by Nokia and RIM with 25.5 percent and 12.3 percent shares respectively.
